Ve submit, this is an improper construction to put the

wording of the special condition; though we do not for a

töment mis-interpret the Director of Public Works' motives

in so dàing.

His view, as expressed verbally to us, was that it

was undesirable to have buildings of the height shown on

our plans so near Kennedy Road. That of course is a

matter upon which he is entitled to have his own opinion,

but we dontend that if he had this in view he should have

plainly stated in the Sale conditions that buildings near

Kennedy Road might not exceed 33'.6′′ in height; and that

if on the contrary he had not this in view when the

special conditions were framed then it is not fair or

reasonable now to make use of the words " design and

disposition • to enforce his wishes in a way that no

purchaser could have foreseen.

(1) The result is our client has bought a piece of

land that has a disability attached to it that

he had not anticipated.

(2) He has spent a large sum of money in preparing

it as a site for a building for which if the

Director of Public Works' ruling is uphold

it is not very suitable.

(3). He has made an arrangement to lease it to a

party who may possibly repudiate the arrangement.
